Voorwaarden Internetdiensten en websites (NL)

De internetdiensten en websites van LNRS Data Services B.V. (hierna ook aangeduid met “LexisNexis Risk Solutions Group” of “wij”) worden tot uw beschikking gesteld onder de volgende voorwaarden. Door de internetdiensten en websites te gebruiken, wordt u (de “gebruiker”) geacht deze disclaimer en gebruiksvoorwaarden te accepteren.

Alle rechten op de inhoud van de internetdiensten en websites van LexisNexis Risk Solutions Group berusten bij LexisNexis Risk Solutions Group, voorzover deze rechten niet berusten bij derden van wie materiaal beschikbaar is gesteld op de internetdiensten en websites van LexisNexis Risk Solutions Group.

LexisNexis Risk Solutions Group behoudt zich het auteursrecht op de inhoud van de internetdiensten en websites voor.

Gebruiker erkent de (intellectuele) eigendomsrechten, inclusief databankrechten, van LexisNexis Risk Solutions Group en haar toeleveranciers op de inhoud van de internetdiensten en websites van LexisNexis Risk Solutions Group, zowel in haar geheel als gedeelten daaruit, dan wel vervat in alle aantoonbaar daarop gebaseerde en/of daaraan ontleende informatie, ongeacht of zodanige daarop gebaseerde en/of ontleende informatie (mede) het product is van een bewerking, veredeling of aanpassing door een ander dan LexisNexis Risk Solutions Group c.q. haar toeleveranciers.

Gebruiker mag de inhoud van de internetdiensten en websites van LexisNexis Risk Solutions Group slechts voor eigen gebruik raadplegen en gebruiken.

Het is gebruiker niet toegestaan om informatie verkregen uit de internetdiensten en websites van LexisNexis Risk Solutions Group op niet-incidentele basis openbaar te maken, te verveelvoudigen of te verkopen in welke vorm dan ook, daaronder begrepen het al dan niet na bewerking integreren in netwerken of op meerdere beeldschermen (doen) verschijnen of anderszins openbaar maken.

De verwerking van de gegevens op de internetdiensten en websites van LexisNexis Risk Solutions Group en de totstandkoming daarvan is naar beste weten en met de grootste zorg uitgevoerd. LexisNexis Risk Solutions Group noch haar toeleveranciers kunnen evenwel instaan voor de juistheid en de volledigheid van de informatie die op de internetdiensten en websites van LexisNexis Risk Solutions Group is opgeslagen en zijn dan ook, behoudens opzet of bewuste roekeloosheid van LexisNexis Risk Solutions Group c.q. haar toeleveranciers, niet aansprakelijk voor schade die is ontstaan als gevolg van onjuistheid, onvolledigheid of onrechtmatigheid van de inhoud van de via de internetdiensten en websites van LexisNexis Risk Solutions Group aangeboden informatie. Voor de inhoud van materialen die door derden op of via de website worden geplaatst zijn wij niet verantwoordelijk. Degene die dat heeft aangeleverd is zelf voor de inhoud daarvan verantwoordelijk. Informatie die van essentieel belang is voor gebruiker dient altijd door gebruiker op juistheid te worden geverifieerd. LexisNexis Risk Solutions Group is niet aansprakelijk voor het als gevolg van een storing niet toegankelijk c.q. beschikbaar zijn van de internetdiensten en websites van LexisNexis Risk Solutions Group voor gebruiker.

Op elk gebruik van de internetdiensten en websites van LexisNexis Risk Solutions Group zijn de volgende voorwaarden van toepassing. Bij het gebruik daarvan dient u:

in overeenstemming met alle toepasselijke wettelijke bepalingen te handelen;
alle toepasselijke gedragscodes na te leven; en
de eventueel door ons te verstrekken instructies na te leven.
U dient zich te onthouden van de volgende handelingen:
gebruik op een wijze die schadelijk is voor ons of voor onze gelieerde ondernemingen, onze klanten, voor andere gebruikers van onze internetdiensten en websites, of voor derden;
het sturen van ongewenste berichten van commerciële aard (‘spam’) aan personen van wie u het emailadres via de internetdiensten en websites van LexisNexis Risk Solutions Group heeft verkregen;
het wijzigen, beschadigen, uitschakelen, overbelasten, hinderen, of het belemmeren van het gebruik van de internetdiensten en websites van LexisNexis Risk Solutions Group;
het bedreigen, beledigen, discrimineren of hinderen van anderen;
het aanleveren van materiaal of berichten die opzettelijk onjuist, bedreigend, beledigend, discriminerend, intimiderend, onrechtmatig, lasterlijk, vulgair, obsceen, smadelijk, misleidend of frauduleus zijn of zo kunnen worden opgevat, of die expliciete of grafische beschrijvingen bevatten van seksuele handelingen, of die inbreuk maken op de privacy van anderen; en
het verspreiden van virussen of documenten die andere schadelijke componenten bevatten.

Indien u materialen of bijdragen naar de internetdiensten en websites van LexisNexis Risk Solutions Group zendt, wordt dat geacht niet vertrouwelijk te zijn. Door toezending verleent u ons een onbeperkt, wereldwijd, eeuwigdurend, onherroepelijk, niet-exclusief en volledig voor sublicentie vatbaar recht om die materialen en bijdragen voor deze en andere websites te gebruiken, te publiceren, te wijzigen, te vertalen, te verwijderen (al dan niet op verzoek van derden), uw naam in verband daarmee te publiceren, en uw gegevens bekend te maken aan derden indien wij daar naar ons redelijke oordeel toe verplicht zijn. U staat er voor in dat u met betrekking tot alle door u ingediende materialen en bijdragen de bevoegdheid heeft om ons deze toestemming te verlenen, en u vrijwaart ons van alle vorderingen van derden in dit verband.

Op het gebruik van onze internetdiensten en websites is ons Privacybeleid van toepassing.

Wij respecteren de (intellectuele eigendoms) rechten van derden, en vragen hetzelfde van de gebruikers van de internetdiensten en websites van LexisNexis Risk Solutions Group. Indien u meent dat er inbreuk wordt gemaakt op uw rechten, verzoeken wij u ons te voorzien van de volgende informatie:

uw adres, telefoonnummer en e-mailadres;
een beschrijving van het auteursrechtelijk beschermde werk of enig ander recht waarop volgens u inbreuk is gemaakt;
een beschrijving van de plaats waar het beweerdelijk inbreukmakende materiaal is aangetroffen;
een verklaring van u dat u te goeder trouw van mening bent dat er geen toestemming is gegeven voor het betwiste gebruik;
een verklaring van u dat de door u verstrekte informatie juist is en dat u bevoegd bent om op te treden;
uw handtekening en een kopie van uw legitimatiebewijs.

The internet services and websites of LNRS Data Services B.V. (hereinafter also to be referred to as “LexisNexis Risk Solutions Group” or “we”) are made available to you under the following terms and conditions. By using the internet services and websites you (the “user”) are deemed to have accepted this disclaimer and the terms of use.

All rights to the contents of the internet services and websites of LexisNexis Risk Solutions Group are vested in LexisNexis Risk Solutions Group, in so far as these rights are not vested in third parties whose material has been made available on the internet services and websites of LexisNexis Risk Solutions Group.

LexisNexis Risk Solutions Group reserves the copyright to the contents of the internet services and websites.

The user acknowledges the proprietary rights and intellectual property rights, inclusive of data base rights, of LexisNexis Risk Solutions Group and its suppliers to the contents of the internet services and websites of LexisNexis Risk Solutions Group, both in its entirety and parts thereof, and/or included in all information that is demonstrably based thereupon and/or derived therefrom, notwithstanding whether such information based thereupon and/or derived therefrom is (also) the product of processing, improvement or adaptation by another party not being LexisNexis Risk Solutions Group and/or its suppliers.

The user may consult and use the contents of the internet services and websites of LexisNexis Risk Solutions Group only for personal use.

The user is not allowed to disclose, reproduce or sell the information obtained from the internet services and websites of LexisNexis Risk Solutions Group on a non-incidental basis, in whatever form, including, whether or not after processing, to integrate this information in networks or to show it or have it appear on various computer screens or to otherwise disclose this information.

The processing of the data on the internet services and websites of LexisNexis Risk Solutions Group and the establishment thereof was performed to the best of knowledge and with the utmost care. However, neither LexisNexis Risk Solutions Group nor its suppliers can guarantee the correctness and the completeness of the information that has been saved on the internet services and websites of LexisNexis Risk Solutions Group and therefore, with the exception of intent or gross negligence on the part of LexisNexis Risk Solutions Group and/or its suppliers, they are not liable for damage occurred as a result of incorrectness, incompleteness or unlawfulness of the contents of the information offered via the internet services and websites of LexisNexis Risk Solutions Group. You must refrain from the following activities:

use of the internet services and websites in a manner that is detrimental to us or to our affiliated companies, our customers, other users of our internet services and websites or third parties;
sending unwanted messages of a commercial nature (‘spam’) to persons whose e-mail address you have obtained through the internet services and websites of LexisNexis Risk Solutions Group;
altering, damaging, disconnecting, overloading, hindering or obstructing the use of the internet services and websites of LexisNexis Risk Solutions Group;
threatening, insulting, discriminating or hindering others;
supply of material or messages which are or may be interpreted to be intentionally incorrect, threatening, insulting, discriminating, intimidating, unlawful, defamatory, vulgar, obscene, humiliating, misleading or fraudulent, or that contain explicit or graphical descriptions of sexual acts, or that infringe the privacy of others;
distribution of viruses or other files that contain harmful components.

Any material or contributions you may send to the internet services and websites of LexisNexis Risk Solutions Group will be deemed not to be confidential. By sending this material or contributions to the internet services and websites of LexisNexis Risk Solutions Group you grant us an unrestricted, worldwide, perpetual, irrevocable, non-exclusive and fully sub-licensable right to use this material and contributions for this and other websites, to publish, modify, translate, remove (whether or not at the request of third parties) this material and contributions, to publish your name in connection thereto and to disclose your data to third parties if we, in our reasonable opinion, are obligated to do so. You guarantee that you are authorized to grant such permission to us with regard to all material and contributions you have submitted and you shall indemnify us against all third-party claims in this respect.

Our Privacy Policy applies to the use of our internet services and websites.

We respect the rights and intellectual property rights of third parties, and we expect the same from the users of the internet services and websites of LexisNexis Risk Solutions Group. If you believe that your rights are being infringed, we request you to provide us with the following information:

your address, telephone number and e-mail address;
a description of the work protected by copyright or any other right which you believe is being infringed;
a description of the location of the allegedly infringing material;
a statement by you that you have a good faith belief that the disputed use is not authorized;
a statement by you that the information submitted by you is accurate and that you are authorized to act;
your signature and a copy of your proof of identity.
